I am bringing this resolution at the suggestion of our Law Department following our previous zoning meeting. It addresses only two rare situations in the code involving use-on-review cases: mining/mineral extraction and airports.
Under the current language, these are the only use-on-review cases that go before the Commission rather than following the standard process through Planning and, if appealed, the BZA. The resolution simply cleans up the code so these two exceptions follow the same process as other use-on-review cases.
This is a clarification and cleanup of the existing process, not a substantive change to zoning policy. That said, I don’t think this is an issue worth fighting over, and I am willing to withdraw the resolution if there is significant opposition.
