      I will be circulating several attachments to aid in your consideration of this proposal:

      1) A copy of the opinion for the case, Food & Water Watch, Inc. et al. v. United States Environmental Protection Agency, et al., No. 17-cv-02162-EMC, 2024 WL 4291497 (D. Cal. Sept. 24, 2024). This is the case that was pursuant to the Toxic Control Substances Act, in which the court found that Food & Water Watch proved “by a preponderance of the evidence, that water fluoridation at the level of .7 mg/L – the prescribed optimal level of fluoridation in the United States – presents an “unreasonable risk of injury to health or the environment, without consideration of costs or other non-risk factors, including an unreasonable risk to a potentially exposed or susceptible subpopulation.” The court ordered the EPA to change the regulations addressing fluoride as requested by the Plaintiffs. The plaintiffs won this case unequivocally.

      2) A copy of the complaint filed in this case

      3) A copy of the groundwater fluoride concentration map for Tennessee. It indicates that our region naturally has less than .7 mg/L in the untreated groundwater.

      4) A copy of the minutes from the May 2025 meeting of the Knox Chapman Board.
