      Commissioners,

Re: Immediate Public Safety / Dangerous Pole Ordinance (edit)

I thought about Mr. Hill’s (AT&T) discussion point on the dangerous pole ordinance regarding private contracts between parties. While certainly public utilities have public records acts that may apply where contracts are concerned, private companies such as Comcast, AT&T, TDS Telecom, WOW!, etc. do not. And as AT&T (for example) does own some poles, and could have private contracts with other “attachers” I see the point clearly. Agreeing that public records disclosure should not, and does not, apply to private companies, I have asked for section 2(b.) to be removed from the ordinance as drafted. This will be reflected in the ordinance considered at Monday’s meeting. Both a new version, and a red-line version will be uploaded to the digital agenda soon.

Let me know if you have any questions on this or the ordinance overall.

      – Commissioner Jay
