      Damon,

      After reviewing this amended ordinance and the prior first drafts, I think the remaining item I would like addressed is the “Affordable Housing” component. The ordinance defines “affordable housing”, but it lacks direction and restrictions on how Knox County staff implements such restrictions. I recommend that we include a statement that any “person” that purchases greater than 99 housing units in Knox County using such exemption provide an annual statement to Knox County (not sure what department this would impact” listing all Knox county units with documentation showing that the units are either currently rented as “affordable housing” or that they are being marketed for this amount, if not rented.

      I recommend that the Law Director opine on how we can insert language that defines this in better terms and how this can be enforced and oversight provided.

      My largest concerns on this, and any ordinance, are the additional compliance oversight from Knox County staff, as well as the litigation and costs of such.
