      Commissioners,

By now, you have either seen the news or one of the concerned constituent emails regarding the alleged assault that happened at Jackson Terminal this weekend. It is reported that this assailant was the newly appointed BZA member that we just confirmed for District Nine.

With that being said, I am submitting my proposed written charges to you by email now, and a draft of the resolution will soon be published to the agenda with my charges as the exhibit. The Law Directors office is assisting with form.

The charges attached to this email ask for a fair hearing and a decision based on evidence. They also ask that the respondent’s identity and appointment be confirmed against Commission records before formal action is taken. They do not ask the Commission to treat a police citation or news reports as proof, or to presume that the alleged conduct occurred without legal justification. This submission does not ask Commission to presume criminal guilt from a police citation, to punish political affiliation or expression, or to substitute a political disagreement for a finding of misconduct.

Additionally, you will soon find Resolution 26-10-904 submitted for consideration to be added to the agenda. Its caption reads as follows:

A RESOLUTION OF THE COMMISSION OF KNOX COUNTY, TENNESSEE, REQUESTING THE COMMISSION TO HOLD A PUBLIC HEARING TO CONSIDER REMOVING ALEX MOODY FROM THE KNOX COUNTY BOARD OF ZONING APPEALS.

I welcome co-sponsors on the resolution calling Mr. Moody for a public hearing, and hope that you will support adding it to the agenda this month, instead of making the public wait until November. It is clear that the public wants the answers, and Mr. Moody deserves the chance to explain outside the press.

      BRH
